NAGPUR: Coming to the rescue of CBSE students from Jain International School here, the Supreme Court (SC) has directed the comptroller of examinations to reconsider their grievances regarding anomalies in awarding marks in Std XII papers.
While adjourning the hearing till July 12, a division bench comprising justices AM Khanwilkar and JB Pardiwala directed the comptroller to consider all aspects on merit and pass orders in two weeks on a plea filed by 23 students through counsel Kartik Shukul and others.
“We deem it appropriate to direct the comptroller to reconsider the grievances of the petitioners. He should take appropriate decision as may be advised. It includes taking assistance from the technical team to explain the flow of algorithm/software which provides for different deduction of different marks student-wise,” the bench said.
The judges clarified that it will be open to the petitioners to submit a formal representation to the comptroller within one week which can be considered appropriately by the authority on its own merits on the same lines as referred to in the companion case (WP(C) No(s). 139/2022).
The aggrieved students challenged the marks allotted to them as per 30:30:40 formula for Std X, XI and XII, respectively, for the 2021 CBSE examinations. They had scored satisfactory marks in the earlier exams and were aspiring to pursue higher studies from top universities and colleges in India as well as abroad. They pointed out that the respondents, including the CBSE, had failed to apply the formula of 30:30:40 in the right perspective as directed by the apex court.
The petitioners accused the central board of reducing their marks awarded by the school, without any authority. “Renowned institutions like IITs and BITS Pilani along with foreign universities consider the Std XII marks for admissions. Even the corporates check these marks during their recruitment drives. The less marks also affecs the morale of students and their overall academic progression,” Shukul contended.
According to him, the school has taken viva of the students and allotted the marks on its basis. The marks which are shared by the school are very good, but those are not reflected in the final results declared by the CBSE.
“The practical exams were the only internal assessment conducted by CBSE. It should have awarded marks in the theory portion on the basis of this assessment. However, it is apparent that their marks are not proportionate, or even based on practical examination,” he said.
