Dolphins’ Xavien Howard files motion to dismiss STD lawsuit

Miami Dolphins cornerback Xavien Howard filed a motion on Friday to dismiss a complaint by an unnamed woman alleging that he knowingly and negligently gave her a sexually transmitted disease.

Through his attorney, Alan Mensa-Wilmot, Howard called it “the epitome of a shakedown,” according to ESPN, which reported that Howard’s motion was filed two days after the plaintiff filed their complaint against him in Broward County on Oct. 26.

The plaintiff alleges Howard knowingly gave her an STD during the course of a multi-year sexual relationship. The woman is demanding a trial by jury and is suing Howard for damages in excess of $30,000, according to the lawsuit.

Howard’s motion reportedly includes a number of screenshots showing alleged text messages from the plaintiff, listed as Jane Doe, which “make it abundantly clear that Plaintiff is nothing more than a scorned ex-lover” seeking a financial gain.

In the motion, Howard alleges that the plaintiff threatened him, trespassed on his property, stalked him and spread false information about him.

Howard’s motion, according to the outlet, states that he “has his own causes of action that he intends to bring against” Doe for her alleged “harassing tactics, defamatory statements, and intentional and/or negligent infliction of emotion distress.”

It continues to state that Howard “has the right to compel Plaintiff to disclose her identity so that he may properly face his accuser in a court of law,” and that the Plaintiff did not “satisfy the burden” she must meet in order to file anonymously.

The motion, according to the outlet, also states that the Plaintiff must use her real name in court pleadings, and that failure to do so is grounds for dismissal.

On Monday, attorneys for the plaintiff, Bradley J. Edwards and Brittany N. Henderson, filed a motion to grant Jane Doe permission to continue anonymously.

According to ESPN, that motion states that Jane Doe has sustained embarrassment, humiliation and psychological trauma that “would be greatly exacerbated if her name was revealed publicly.”

Howard is a key defensive piece for Miami, which added linebacker Bradley Chubb at the deadline on Tuesday. Howard started in all seven games with five passes defended and 22 combined tackles. 

Howard is in the first year of his five-year, $90 million deal with the Dolphins.
