PUNE: The Samarth police are investigating a complaint by the father of one of the three Std X students of a school accusing three teachers of caning and thrashing the students over `ruckus in classroom’ on the afternoon of July 28.
Based on the complaint, the police have registered a case for offences punishable under section 75 (person in-charge of a child assaulting the child) of the Juvenile Justice (JJ) Act and section 34 (common intention) of the Indian Penal Code. Corporal punishment is banned under the JJ Act provisions
Senior inspector Ramesh Sathe of Samarth police station said, “The complainant (42), a resident of Yerawada, has alleged that apart from caning and thrashing his son and two other students, the teachers also threatened that they won’t issue internal marks to the students. We took the students, all aged 15 years, to the Sassoon general hospital for medical examination and after receiving their injury certificate, we registered the case.”
According to the FIR, “The students were playing among themselves and then created a ruckus in the classroom. The three teachers came to the classroom and caned them. Following this, the teachers took these three students to the staff room and again beat them up when the students were begging for a pardon. After beating them up, the students were allowed to leave the staff room. The students went home and narrated the incident to their parents.”
‘If teacher assaults student, principal too responsible’
A sessions court in Nagpur in August 2021 ruled that being head of the institution, a principal had responsibility of anything happening on the school premises between teachers and students.
Additional sessions judge P Y Ladekar maintained charges framed by police against Suyash Convent Anurag Pandey under Section 75 of Juvenile Justice (JJ) Act for alleged assault and misbehaviour by his against female students.
“Undisputedly, the accused is principal of the school. He, with the managing body, employed the first accused teacher to teach dance. Being principal/headmaster, he certainly had control over the students and teacher,” the judge said.
The court was hearing Pandey’s application for discharge from the offences registered under Section 324 (voluntarily causing hurt with dangerous weapons) of IPC and JJ Act by a dance teacher, who had allegedly thrashed minor girls with an iron rod during practice, injuring them on November 30, 2011. The was lodged by the father of a Std VII girl.
